GENERAL Terms and Conditions – Goliath Contest SPONSORED BY Contest is sponsored by Goliath B.V., Vijzelpad 80, 8051 KR Hattem, the Netherlands, or any of its affiliated companies. (“Goliath”). Goliath will be responsible for all aspects of this contest. ELIGIBILITY If not stated otherwise in the specific terms of a specific contest, the Contest is open to all individuals, of all ages (“Participant”), provided that under-aged children always need permission of a parent and/or guardian to enter a Contest. Goliath’s families and immediate families are eligible to enter but not eligible to win the Prize. For entries to be eligible, Participants must completely and accurately enter all information to enter. Participants must be the rightful owner of the e-mail address used for entrance within the Contest. Goliath reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon meeting all requirements set forth herein. Participants who do not meet those requirements will be disqualified, and their submissions will be void. For entries to be eligible, Participants must completely and accurately enter all information to enter. Any Participant under age 18 needs parental permission to enter. Parents/Guardian’s email address must be added to the registration form in order for Submission to be valid. All submissions must be received by 11:59 pm Central Eastern Time (“CET”). HOW TO ENTER Participant shall complete the registration form which will also be based on the specific contest rules and regulations, available at the local website of Goliath (“Submission”). PERMISSIONS The Participant should be able to provide all third-party clearance, releases, and permissions for the Submission, including releases from the entrant and any other third-party participant showed in the Submission, upon request thereof by Goliath. Submission must not contain material which is sexually explicit, obscene, violent, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal, offensive, threatening, profane or harassing. Submissions must not contain any mention or performance of copyrighted media production including but not limited to music, television, books, or television programming. Submissions must not contain material that infringes on any international copyright rules and regulations. Once submitted, all Submissions become exclusive property of Goliath, its parent, affiliates, and subsidiaries, worldwide and in perpetuity. RIGHTS IN SUBMISSIONS In consideration of Participant’s Submission being reviewed and evaluated for this contest, Goliath has exclusive rights to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete, or display any such Submission, or any portion thereof, in any and all media including but not limited to all forms of internet and television. Each Participant authorizes the Goliath and any entities affiliated with the Goliath to utilize the Submission to the Goliath, for eternity and for how they see fit, in connection with any campaigns and any of the Goliath’s programs, including any programs of its parent, affiliates, subsidiaries, and licensees, and to make derivative works from such materials at the sole discretion of Goliath. The Prize Winner may be required to complete and execute additional documents and have third parties execute Goliath’s documents in connection with the rights granted to Goliath. In addition, by participating in the Contest and submitting a Video, each Participant hereby grants permission (except where prohibited by law) for the Goliath to use Participant’s Submission, name, likeness, voice, quotes, comments, biographical information, photograph and/or image for the purpose of advertising, trade, or promotion without further notice, permission, compensation or consideration in any and all media now known, in perpetuity, unless prohibited by law. PRIZE The winner cannot assign or transfer any prize to another person, with the exception of automatic assignment of the prize to the Parent/legal guardian in case of an under-aged Participant. A prize cannot be substituted or redeemed for cash. If a prize or any portion of the prize cannot be awarded due to circumstances beyond the control of the Goliath, then a substitute prize may be awarded at sole discretion of Goliath. Winners are responsible for any risk of loss associated with the prize or any portion of the prize after it has been delivered. INTERNET LIMITATIONS OF LIABILITY Goliath assumes no liability for any error in transmission, communications line failure, theft, destruction, or alteration of entries. PRIVACY By entering any Submission, the Participant declares that he/she has read the Privacy Statement of Goliath (https://www.goliathgames.nl/privacy-policy/) and agrees with the conditions mentioned therein. LAW These Terms and Conditions shall be governed by Dutch law and the courts of the Netherlands shall have exclusive jurisdiction. The BOOMTRIX Video Contest (“Boomtrix Contest”) will be held online from 12:01 am Central Eastern Time (“EST”) September 10, 2018 (“Boomtrix Contest Start Date”) to 11:59 pm Central Eastern Time (“CET”) December 31, 2018. (“Boomtrix Contest Period.”) SPONSORED BY Contest is sponsored by Goliath B.V., Vijzelpad 80, 8051 KR Hattem, the Netherlands (“Goliath”). Goliath will be responsible for all aspects of this contest. ELIGIBILITY The Boomtrix Contest is open to all individuals who are legal residents in the Benelux, Germany, France, Spain, Portugal, Italy, Austria, Switzerland and the UK, of all ages (“Participant”). Any Participant under age 18 needs parental permission to enter. Parents/Guardian’s email address must be added to the registration form in order for contest submission to be valid. All eligible submissions must be received before the end of the Boomtrix Contest Period. Goliath is not responsible for late or unsuccessful attempts to submit a video. PRIZE The prize winner will receive a trip (weekend, i.e. Fri-Sun/Sat-Mon) to an amusement park in Europe for two persons. Goliath will choose the amusement park, will arrange and pay for the transportation to and from the park, the hotel will be paid and Goliath will provide pocket money in the amount of €100. The prize will not include travel insurance, the cost of transfers to and from airports or stations, food and drinks, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner. HOW TO ENTER During the Boomtrix Contest Period, Participant shall upload a video to YouTube using the hashtag #BoomtrixChallenge and submit the URL of the YouTube movie by completing the registration form located at http://boomtrix.com (“Submission”). JUDGING The winner will be selected by a qualified jury based on creativity, courage, originality and length of the trajectory, from all qualifying Submissions. The Judging period for the Boomtrix Contest begins January 1, 2019, and ends January 31, 2019. RIGHT IN SUBMISSIONS Each Participant authorizes the Goliath and any of its affiliated companies to utilize the Submission to Goliath, for eternity and for how they see fit, in connection with the Boomtrix and/or other campaigns and any of the Sponsor’s programs, including any programs of its parent, affiliates, subsidiaries, and licensees, and to make derivative works from such materials at the sole discretion of Sponsor.
